EV5610 - Native Title and Land Use Planning

The subject will bridge the gap between university graduate and practicing Urban and Regional Planner through the development of knowledge and skills underpinning the Native Title process and land use planning system. The subject introduces students to the common law and statutory theory of Native Title. The subject will specifically focus on Native Title law including the creation and implementation of Indigenous Land Use Agreements and how the governance procedures within the law impact upon development opportunities. A detailed case study examination of the statutory regime for the recognition and protection of native title rights and interests as these relate to land use planning in northern Australia will be undertaken. This subject if offered externally and can be taken by students from any JCU campus.

Learning Outcomes

  • develop advanced knowledge through review, analysis and evaluation of the theory, common law and statutory law relating to native title, and how native title rights and interests are recognised and protected in Australia;
  • demonstrate the ability to critically analyse how native title law and policy is accommodated in contemporary land use planning systems, and to utilise an advanced level of independent judgement in identifying development opportunities and impediments;
  • demonstrate the ability to synthesise specialised knowledge of both planning and native title legislative regimes, identify and develop solutions to complex land use planning issues, and critically evaluate the effectiveness of decisions with respect to achieving beneficial outcomes for Native Title claimants/holders;
  • develop advanced technical knowledge of land use planning systems and processes through critical review of existing planning projects involving Native Title claimants/holders, and demonstrate the ability to make high-level independent analyses and evaluations of these terms of their impacts (adverse or otherwise) on Native Title claimants/holders.
